Product Quality Guidelines

These Product Quality Guidelines (“Guidelines”) describe the standards that apply to all products listed on the avnu marketplace (the “Platform”). These Guidelines are incorporated by reference into the Merchant User Agreement.
Participation on avnu requires ongoing compliance with these Guidelines. avnu reserves the right to review, suspend, or remove any product or merchant at its sole discretion.
1. General Product Standards
All products must:
- Be lawful to sell in the United States
- Comply with all applicable federal, state, and local laws
- Be safe for their intended and reasonably foreseeable use
- Match their listing descriptions, images, selected variants, condition, identifiers, prices, and availability; listings must accurately identify the merchant and all material purchase conditions
- Be free from material defects
Products must not misrepresent:
- Materials
- Origin
- Functionality
- Durability
- Safety
2. Regulatory & Compliance Obligations
Merchants are solely responsible for ensuring regulatory compliance, including but not limited to:
- Consumer Product Safety Commission (CPSC) standards
- Federal Trade Commission (FTC) advertising standards
- Textile and fiber labeling laws
- Country-of-origin labeling requirements
- State-specific consumer protection laws
avnu may request documentation, certifications, or testing records at any time.
Failure to provide documentation upon request may result in removal.
3. Children’s Products (Heightened Standard)
Children’s products—products designed or intended primarily for children 12 years of age or younger—must comply with applicable laws, including the Consumer Product Safety Improvement Act (CPSIA).
Merchants must:
- Ensure compliance with lead and phthalate limits
- Maintain required testing and certification
- Provide Children’s Product Certificates where applicable
- Include required tracking labels
Merchants must obtain testing from CPSC-accepted laboratories and maintain certificates where required by law, subject only to applicable statutory exceptions. avnu may require proof before permitting such products; platform approval is not a substitute for required testing.
4. Cosmetics & Personal Care Products
Cosmetics, skincare, and personal care products must:
- Comply with FDA labeling and ingredient disclosure requirements
- Avoid unsubstantiated medical or therapeutic claims
- Properly disclose ingredients where required
- Avoid claims implying FDA approval unless legally authorized
Merchants must comply with applicable cosmetic safety substantiation, adverse-event reporting, facility registration, and product listing requirements, including applicable exemptions. Cosmetic claims must not misrepresent a product as diagnosing, treating, curing, or preventing disease. Products making unlawful or unsupported medical or drug-like claims may be removed.
5. Materials & Chemical Safety
Products must not contain hazardous or restricted substances in violation of applicable laws.
Merchants are responsible for ensuring:
- Compliance with chemical safety regulations
- Accurate safety disclosures
- Proper labeling of materials
If required by law, warnings must be included.
6. California Proposition 65
Merchants are responsible for compliance with California Proposition 65 where applicable.
Where required, clear and legally compliant warnings must appear on the product or packaging and in online offers before purchase. Merchants must supply avnu with the warning text and product-specific information needed to display it.
Failure to comply may result in immediate removal.
7. Prohibited & Restricted Products
The following products are prohibited:
- Alcohol, tobacco, vaping, cannabis, CBD, or controlled substances
- Firearms, ammunition, weapons, weapon accessories, or weapon components
- Hazardous materials
- Recalled or unsafe products
- Counterfeit goods
- Products infringing intellectual property rights
- Adult, sexually explicit, or obscene content
- Medical devices, pharmaceuticals, or ingestible supplements requiring regulatory approval
avnu may update restricted categories with notice where required. Listing on avnu does not guarantee eligibility for Google Shopping, other advertising channels, or payment services. Products and claims must also meet the rules of each channel used to promote them; merchants must supply accurate compliance information and must not evade disapprovals.
8. Intellectual Property & Anti-Counterfeit Enforcement
Merchants must have the legal right to sell and market their products.
Prohibited conduct includes:
- Selling counterfeit or knockoff goods
- Using copyrighted content without authorization
- Infringing trademarks, trade dress, or patents
avnu may remove listings upon receiving credible intellectual property complaints.
Merchants must cooperate with investigations and may be required to provide proof of authenticity.
Repeated or willful infringement may result in permanent removal.
9. Product Condition & Packaging
Products must be:
- New and unused unless clearly disclosed
- Manufactured under reasonable quality control standards
- Properly packaged to prevent damage during shipment
Repeated damage due to inadequate packaging may result in corrective action.
10. Environmental & Sustainability Claims
Environmental claims must:
- Be truthful and not misleading
- Have a reasonable and substantiated basis
- Avoid vague or unqualified representations
Claims such as “eco-friendly,” “non-toxic,” or “sustainable” must not exaggerate environmental impact.
11. Safety Incidents & Recall Obligations
Merchants must promptly notify avnu of:
- Known product defects
- Safety complaints suggesting systemic issues
- Regulatory inquiries
- Voluntary or mandatory recalls
Merchants must immediately stop offering and shipping affected products when a recall or known serious safety risk requires it, notify avnu at info@shopavnu.com, and cooperate in removing listings, notifying customers, and providing legally required remedies. Notifying avnu does not replace any independent duty to report to regulators.
Failure to disclose known risks may result in immediate termination.
12. Ongoing Monitoring & Enforcement
avnu may:
- Conduct listing reviews
- Request documentation or certifications
- Remove listings
- Suspend or terminate merchant participation
Compliance with these Guidelines is an ongoing condition of platform participation.
